By reserving a yacht or using our Service, you consent to be subject to these Terms. If any part of the terms is not agreeable to you, then you are advised not to use the Service.

2. Service Overview

SoftLeafGallery offers luxurious yacht charter services such as:

  • Yacht hires for the day
  • Evening yacht tours
  • Business retreats
  • Exclusive gatherings
  • Extended yacht charters

All offered services are dependent on vessel availability and weather conditions. We hold the right to adjust or terminate services at our discretion without prior notice.

3. Booking and Reservations

3.1 Booking Process

When looking to reserve a yacht, you are required to:

  • Be no less than 18 years old
  • Provide accurate and comprehensive details
  • Make a payment for the deposit as indicated in your reservation confirmation
  • Accept these Terms & Conditions

3.2 Confirmation

A reservation is only confirmed with the payment receipt and our written confirmation. We have the discretion to decline service to any individual.

3.3 Availability

The charter services offered are reliant on the availability of the vessel and favorable weather. We will try to honor your requested dates and timings to the best of our ability.

4. Payment Terms

4.1 Pricing

Quoted prices are in € and are inclusive of all applicable taxes unless mentioned otherwise. Prices may be subject to modifications without prior notification.

4.2 Payment Schedule

  • Deposit: A payment of 50% of the complete charter fee at the time of reservation
  • Final Amount: Payable 48 hours before the scheduled departure of the charter
  • Incidental costs (if any): Payable upon the charter's completion

4.3 Payment Methods

Major credit cards, bank wire transfers, and certified cheques are accepted modes of payment. All payments are processed through encrypted, secure channels.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

  • With more than 72 hours before departure: A full refund minus any processing fees
  • Between 24-72 hours before departure: A 50% refund of the fees
  • Less than 24 hours before departure: No refund will be issued

5.2 Weather Cancellations

In case the captain deems the weather to be unsafe, we will either:

  • Propose a reschedule of your charter to another available date without extra charges
  • Give a complete refund if rescheduling isn't feasible

5.3 Mechanical Issues

Should there be mechanical issues with the vessel allocated to you, we will seek to supply a suitable alternative. If no substitution is possible, a full refund will be processed.

6. Safety and Conduct

6.1 Safety Requirements

It is mandatory for all passengers to:

  • Adhere to all directives given by the crew
  • Utilize safety gear when deemed necessary
  • Inform of any health conditions that could impinge on their safety
  • Stay within the allowed sections of the yacht

6.2 Prohibited Items

Items not allowed aboard include:

  • Containers made of glass
  • Illegal substances
  • Firearms or other weapons
  • Excessive amounts of beverages (beyond moderate consumption)
  • Animals (unless given prior authorization)

6.3 Conduct

Passengers are expected to behave in a courteous and respectful manner. Should a passenger's conduct become a safety hazard or interrupt other passengers' experiences, we reserve the right to end the charter without issuing a refund.

7. Liability and Insurance

7.1 Our Liability

We limit our liability to the charter cost you have paid and are not responsible for:

  • Injuries sustained due to passenger carelessness
  • The loss or damage of personal items
  • Indirect or consequential losses, or any punitive damages
  • Delays resulting from inclement weather or other conditions beyond our command

7.2 Insurance Coverage

Our vessels and operations are protected under comprehensive marine insurance. Passengers must ensure their own travel and personal insurance coverage.

7.3 Assumption of Risk

By engaging in our charter services, you accept that marine activities come with intrinsic risks and you take responsibility for your personal safety and wellbeing.

8. Modifications and Itinerary Changes

We have the right to alter itineraries, pathways, or timetables due to weather, safety, or operational prerequisites. We will endeavor to offer alternative experiences of comparable quality.

9. Force Majeure

Our company shall not be held accountable for disruptions, cancellations, or alterations caused by events which are beyond our control. Such instances include, but are not limited to:

  • Extreme weather phenomena
  • Natural catastrophes
  • Legislative mandates
  • Port lockdowns
  • Mechanical breakdowns

10. Privacy and Data Protection

The handling of personal data is compliant with our Privacy Policy. Your use of our services signifies your consent to the collection and use of information as outlined in our Privacy Policy.
